According to a supplementary written opinion issued by the Consultative Council of the Attorney General's Office (PGR) and published in the state journal, on a strike called in surgical departments of public hospitals in November and December, the nurses must lose their salary for the entire period of the strike, despite its being staggered over the period.

"The disproportion between the losses caused to the employer and the salary losses suffered by workers on strike should not be allowed, so that the docking of salaries should take into account not only the actual period in which each worker was in situation of taking part in the strike, but also the remaining periods in which, as a result of that concerted action, services were at a standstill,” the document states.

As for the crowdfunding used by nurses to fund their action, the written opinion states that "it is not permissible for workers who take part in a strike to compensate for the wages lost as a result of this … through the use of a strike fund that is not constituted or managed by the unions that called the strike."
