Through the agency's online contact platform, it is now possible to request an appointment to obtain a Residence Permit under Article 124 of the Foreigners Law. This legal and procedural mechanism is intended exclusively for foreign infants or minors born within Portuguese territory, provided they are the children of foreign nationals who already hold a valid residence title in the country.
To initiate the process, applicants must access the official portal and submit the electronic form, selecting the "Residence Permit" category under the subject type, followed by the specific option for scheduling appointments for minors born in Portugal. AIMA clarifies that, when filling out the digital fields, all entered data must strictly correspond to that of the foreign minor, as the minor is the actual holder of the right in question. The system requires a separate, individualised application for each child who meets these criteria.
The approval of the appointment request is strictly conditional upon the submission of a set of mandatory documents in digital format. Among these, the birth certificate of the infant or minor is particularly important; it must be issued by the competent Portuguese civil registry authorities. Additionally, parents must attach legible scanned copies of the passport of the parent whose status is regularised, of that parent's valid residence title, and, if applicable to the family situation, of the other parent's residence document.
In accordance with the legal framework established by Law No. 23/2007, the granting of this right presupposes that at least one of the parents resides legally in Portugal. The legislation further stipulates a strict time limit for the submission of the declaration of intent, setting a maximum deadline of 6 months from the date of the child's birth registration.
The immigration authority issues a clear warning to applicants, emphasising that any form submitted outside this specific timeframe or that presents deficiencies in the attached mandatory documentation will be automatically and summarily rejected by the services.
