The injunction was filed by the Union of Parishes of Braga (Maximinos, Sé and Cividade), in the name of defending the right to rest of the residents.

The action was contested by the Council, which claimed that the bars would always have to comply with the noise law and that any non-compliance will be sanctioned.

For the Council, if the noise passes through the windows and shutters of the houses, this is due to the poor soundproofing conditions of the buildings.

Conditions for which, it adds, it cannot be blamed.

In its opposition to the action, the Council also cited the “significant losses” to the turnover of the bars in question, with losses in revenue that could be crucial to their survival.

In today’s ruling, the court dismissed the injunction, stressing that the alleged harmful situation for residents is not new, but began in 2015, as the plaintiffs in the action claim.

Therefore, the ruling states, that there is no risk of a fait accompli being established, and the harmful situation may be ended through future intervention by the court.

The 2024 edition of Noite Branca kicks off today and runs until Sunday, with Pedro Abrunhosa, Carminho and Bárbara Bandeira on the bill.

Other performers will be Os Quatro e Meia, Bispo, Van Zee, Wet Bed Gang, Deejay Telio and Daniel Pereira de Cristo on the six stages spread across the city.

In total, there will be more than 48 hours of programming and more than 170 cultural moments.
